What is known about the lawyer Elman Pashayev: the death of a family in an accident, a criminal record and something else

The name of Elman Pashayev, the lawyer of actor Mikhail Efremov, who arranged a fatal accident, has been in the news no less often in recent months than the name of his ward. He then intrigued the court and journalists, promising to present a witness of the defendant's innocence, then allowed himself incorrect statements about the victims, then promised a sensation. What do we know about this bright personality, who made a lot of noise, but did not protect Efremov from an impressive prison term?

During the trial, the world learned a lot of interesting facts about Pashayev that had previously remained in the shadows. Elman Maharram oglu Pashayev was born on December 22, 1971 in the Armenian SSR, in the village of Shishkaya, Basargechar district. When the boy was 15 years old, his father, mother and two brothers died in a car accident caused by a Kamaz driver who, like Efremov, got behind the wheel drunk. Pashayev told the press about this sad fact only in June 2020, when he was already defending the actor.

The Kamaz driver, who was responsible for the deaths of four people, had two minor children and Elman Pashayev's relatives, instead of demanding the harshest punishment for him, did everything to avoid a prison term. They did not want the fate of an orphaned boy to befall two innocent children as well.

Pashayev grew up in a family of relatives, and in 1997 moved to Moscow. In the capital, he graduated from the First Moscow Law Institute, after which he also studied at the Moscow State Law Academy named after O. E. Kutafin and at the graduate school of this university.

But before becoming a lawyer, Pashayev changed several professions. Before entering the institute, immediately after the army, he worked as a journalist in the newspapers "Akhtarysh" and "Hag sozu". Then he worked for some time in the office of the Ministry of Internal Affairs of Azerbaijan, but very little is known about this part of the work of the future scandalous lawyer.

In the lawyer's professional activity of Pashayev, everything is also not so simple. The Qualification Commission of the Bar Chamber of the Republic of North Ossetia-Alania, of which Elman Pashayev is now a member, on September 9, 2020, recognized his violation of the Code of Professional Ethics of a lawyer. The consequence of this may be a remark, a warning, and even the termination of the status of a lawyer.

In 2011, Pashayev was expelled from the Moscow Bar Association "Aegis" on the complaint of an opponent, but just a year later he was restored to the status of a lawyer. Only to be deprived of it again in 2013. The lawyer worked not only in the capital — the lawyer was also listed in the registers of the chambers of advocates of the Krasnodar Territory, where his status has now been terminated, and the Yamalo-Nenets Autonomous Okrug, where he was excluded from the register.

In 2016, Elman Pashayev, once again deprived of the right to practice law, unexpectedly goes into the real estate business. An unpleasant story is also connected with this page of the lawyer's biography. In 2017, Pashayev convinced entrepreneur Anzor Psunokov to lend him 2.5 million rubles for a lucrative real estate deal, but he simply appropriated the money and refuses to give it back.

Pashayev is a witness in this case, and it has dragged on. On September 4, another confrontation of Pashayev and Psunokova. Interestingly, the odious lawyer claims that he does not owe Psunokov money, but on the contrary — that's how he tells reporters. But Pashayev also claims that everything is tied to Psunokov's wife, who is now appearing in the criminal case of fraud as a suspect.

In 2018, Elmar Pashayev was suspected of extortion and the court even chose a preventive measure for him in the form of detention for a period of two months. But then the article was reclassified to Part 2 of Article 330 of the Criminal Code of the Russian Federation ("Arbitrariness") and the Mytishchi court sentenced him to one year of probation. It so happened that Pashayev's term ended 4 days before Yefremov committed a fatal accident.

The story, because of which Pashayev received a criminal record, can be called very ugly. One woman, who was facing a real prison sentence, paid an intermediary to help her get out of custody, close a criminal case and hide abroad. "Reshala" took the money, but did not fulfill its obligations, and refused to return the money.

The court took into account that Pashayev had not been brought to criminal responsibility before, as well as a partial admission of guilt by him. In addition, he reimbursed the costs of treatment and material damage caused to the victim. The presence of a minor child, numerous incentives and certificates from different places of work and a positive characteristic also helped to escape from prison.

However, Panin himself claims that Pashayev has appropriated other people's laurels and the lion's share of success in his case is the merit of a little-known female lawyer from the small provincial town of Sudogda.
